Terms of Usage

Terms and conditions apply which affect your legal rights. Please read the below carefully.

BOOKING CONDITIONS

1. INTRODUCTION

Fowl Cay Resort” means UNIQUE CARIBBEAN HOLIDAYS LIMITED, a company incorporated and registered in England and Wales with company number 04122639, whose registered office is at 2nd Floor Nucleus House, 2 Lower Mortlake Road, Richmond, England, TW9 2JA, trading as Fowl Cay Resort UK.

Unavoidable and Extraordinary Circumstance” means a situation beyond the control of the party who invokes such a situation and the consequences of which could not have been avoided even if all reasonable measures had been taken, which could include: warfare, terrorism, significant risks to human health such as the outbreak of a serious disease at the travel destination, or natural disasters such as floods, earthquakes or weather conditions which make it impossible to travel safely to the destination.

Terms” means these terms and conditions and our Website Terms of Use, Privacy Policy, and Cookies Policy.

we”, “us” and “our” means Fowl Cay Resort.

Website” means the relevant website for your location. UK: https://www.fowl-cay.co.uk/

you” and “your” means all persons named on your booking confirmation and in your travel party.

3. OUR AGREEMENT WITH YOU

Our agreement with you is set out in the Terms, which sets out what you can expect from us when you buy a package holiday or accommodation only through our contact centre. You should read the Terms carefully before you book.

The acceptance of the Terms is a condition of purchasing either a package holiday or accommodation only holiday from us.

4. YOUR TRAVEL BOOKING

4.1. Legal age and responsibility

To confirm the booking, as a lead booking name, you accept and will ensure that you are over the age of 18, have full legal capacity, have the consent of all persons named in the booking, and accept financial responsibility for all transactions.

4.2. Personal Data

By accepting the Terms, you consent to us processing personal information relating to you or your group to process bookings and payments. For more information, see our Privacy Policy.

4.3. The Booking

A contract will only come into existence between us when you have paid the price payable on booking and we have issued our booking confirmation to you. If your departure date is within 14 days of your booking, we are required to carry out additional checks.

4.4 Price Changes

We may change the advertised price of any holiday from time to time. We will confirm the actual price at the time of booking. We may change the price of your holiday after booking confirmation to pass on changes in fuel costs, taxes, or exchange rates, provided we notify you at least 20 days before the start of your holiday. If the price increases by more than 8%, you may accept the increase, reject and receive a full refund, or take an alternative holiday if offered.

5. THE PRICE YOU PAY

5.1. Paying for your Travel Arrangements

If booking in the UK you may pay a deposit for bookings made more than 71 days before departure. The deposit amount is £175pp plus 25% of the accommodation cost. The full balance is due 71 days prior to departure and is non-refundable after this time.

5.1.1. Minimum Length of Stay

Fowl Cay villas require a minimum stay of five (5) nights; see Holiday Travel Dates terms below.

5.1.2 Holiday Travel Dates

All bookings arriving between the below holiday travel dates are subject to an earlier full balance due date:

2025: 01 Jan – 27 April and 21 Nov – 31 Dec 2025

Guests arriving between these dates are required to pay the full balance 150 days prior to departure. These dates require a minimum stay of seven (7) nights.

5.1.3. Security Deposit

All bookings are subject to a £2,000 refundable security deposit at the time of booking. The Security Deposit will not be refunded where the villa or its contents have been damaged, items removed, or extensive additional cleaning is required. Refunds will be made within thirty (30) days after departure.

British Airways Customers

We require full payment 100 days prior to travel for guests travelling with British Airways to Nassau during peak travel periods. Please contact us for applicable dates.

6. IF WE CANCEL YOUR BOOKING

We aim to provide your holiday as booked. If we cancel, we will notify you as soon as possible. Except where cancellation is due to your fault or an Unavoidable and Extraordinary Circumstance, you can either have a full refund or accept a replacement holiday. Compensation may also be payable per the scale in Section 7.

7. IF WE CHANGE YOUR BOOKING DETAILS

If we have to make a major change (significant destination change, lower category accommodation, flight time change of more than 12 hours, or departure airport change), we will notify you as soon as possible. You may then accept the change, reject and receive a full refund, or take an alternative holiday if offered. Compensation is payable per the following scale:

8. IF YOU CHANGE YOUR BOOKING DETAILS

8.1. Name changes

You may transfer your booking to another person before departure, subject to conditions including written authorisation and payment of an amendment fee. Please note flight providers may treat this as a cancellation.

8.2. Booking details changes

Amendment requests must be made in writing by the lead passenger. An amendment fee applies:

9. IF YOU CANCEL YOUR BOOKING

If you want to cancel your booking, call our Administration Team on 0800 742 742. Notice of cancellation must be confirmed in writing by emailing amendments@sandals.co.uk.

Cancellation charges apply per the following scale:

Note: Holiday Travel Date bookings are subject to different cancellation terms — full balance is non-refundable after 150 days prior to departure. Please see Section 5.1.2.

10. FINANCIAL PROTECTION

Fowl Cay Resort is ATOL protected (ATOL number 4358). When you buy a flight inclusive package holiday from us your money is protected by the Air Travel Organisers’ Licencing (ATOL) scheme. If we fail, the Air Travel Trust will pay for your return travel to the UK or for your travel arrangements to continue, or will provide you with a refund.

Fowl Cay Resort is also an ABTA member (ABTA number V4356). You can access ABTA’s dispute resolution scheme at www.abta.com.

11. OUR LIABILITY TO YOU

We accept responsibility if any part of your travel arrangements are not as described in our brochure or website, or if we are negligent and this causes death, injury or illness. We will pay you reasonable compensation. However, we will not be liable where failure is due to your own fault, a third party unconnected with our services, or an Unavoidable and Extraordinary Circumstance.

12. COMPLAINTS

If you have a complaint while on holiday, please inform our local management immediately and they will attempt to solve the problem. If the issue cannot be resolved, please contact us in writing within 28 days of your return to amendments@sandals.co.uk.

13. BEHAVIOUR AND DAMAGE

We expect all guests to behave in a reasonable manner. We reserve the right to terminate the holiday of any guest or group whose behaviour is considered likely to cause offence, danger, damage or distress to others. No refund will be provided in these circumstances. You will be liable for any damage or losses caused to the property.

NO SMOKING inside the Hill House Restaurant or Villas. NO OPEN FIRES on property. Failure to abide by this will incur a penalty fee.

14. YOUR KEY RIGHTS UNDER THE PACKAGE TRAVEL DIRECTIVE

Travellers will receive all essential information about the package before concluding the package travel contract. There is always at least one trader who is liable for the proper performance of all the travel services included in the contract. Travellers are given an emergency telephone number or details of a contact point where they can get in touch with the package organiser. The price of the package may only be increased if specific costs rise (for instance fuel prices) and if this is explicitly provided for in the contract, and in any event not later than 20 days before the start of the package.

If the organiser cancels the package before the start of the package, travellers are entitled to a refund and compensation where appropriate. In exceptional circumstances travellers may cancel the package at any time before the start of the package without paying any cancellation fee, for instance if there are serious security problems at the destination which are likely to affect the package.
